CONSUMER RIGHTS - WITHDRAWAL - CANCELLATION RETURN CONDITIONS

GENERAL:

1.      If you place an order electronically through the website, you are using, you are deemed to have accepted the preliminary information form and the Distance Sales Agreement presented to you.

2.      BUYERS are subject to the provisions of Law No. 6502 on Consumer Protection and Regulation on Distance Contracts (Official Gazette: 27.11.2014 / 29188) and other applicable laws regarding the sale and delivery of the purchased product.

3.      Cargo charges, which are shipping costs will be paid by the BUYERS.

4.      Each product purchased shall be delivered to the person and/or organization at the address indicated by the BUYER provided without exceeding the 30-day legal period. If the product is not delivered within this period, BUYERS may terminate the contract.

5.      The purchased product must be delivered in full and in accordance with the qualifications specified in the order and with documents such as warranty certificate, user manual if any.

6.      If it becomes impossible to sell the purchased product, the SELLER must notify the buyer in writing within 3 days of learning of this situation. The total price must be returned to the BUYER within 14 days.

IF THE PRODUCT PURCHASED IS NOT PAID:

7.      If the BUYER does not pay the price of the purchased product or cancels it in the bank records, the SELLER's obligation to deliver the product ends.

SHOPPING WITH UNAUTHORIZED USE OF CREDIT CARD:

8.      After the delivery of the product, if it is determined that the credit card used by the BUYER is used unfairly by unauthorized people and the price of the product sold is not paid to the SELLER by the relevant bank or financial institution, the BUYER is reponsible to send the product subject to the contract to the SELLER within 3 days. The shipping cost will be covered by the SELLER.

IF THE PRODUCT CANNOT BE DELIVERED WITHIN TIME PERIOD DUE TO UNFORESEEN CIRCUMSTANCES:

9.      If there are force majeure circumstances occurs which the SELLER cannot foresee and the product cannot be delivered within the time period, the BUYER shall be notified. The BUYER may request the cancellation of the order, replacement of the product with a similar product or postponement of the delivery until the obstacle is eliminated. If the BUYER cancels the order; and the payment is made in cash, this fee is paid in cash to the BUYER within 14 days of cancellation. If the BUYER has made the payment by credit card and cancels it, the product price will be returned to the bank within 14 days after this cancellation, but it is possible that the bank will transfer it to the BUYER 's account within 2-3 weeks.

BUYER'S OBLIGATION TO CHECK THE PRODUCT:

10.   The BUYER shall inspect the contractual goods / services subject to the contract before receiving it; crushed, broken, torn package etc. will not receive the damaged and defective goods / services  from the courier company. The delivered goods / services will be deemed to be undamaged and intact. The BUYER must carefully protect the goods / services after delivery. If the right of withdrawal is to be used, goods / services should not be used. The invoice must be returned with the product.

RIGHT OF WITHDRAWAL:

11.   The BUYER can use his/her right of withdrawal, within 14 (four teen) days from the date of the delivery of the purchased product to himself or to the person / organization at the adress indicated, by refusing the goods without any legal or criminal liability and without any justification and informs the SELLER through the following contact information indicated;

THE DURATION OF THE RIGHT OF WITHDRAWAL:

13.   If the BUYER has purchased a service, this 14-day period starts from the date the contract is signed. Before the expiry of the right of withdrawal, the right of withdrawal can not be used in the service contracts whose service is started with the approval of the consumer.

14.   Expenses arising from the use of the right of withdrawal belong to the SELLER.

15.   In order to use the right of withdrawal, a written notification must be made to the SELLER by registered mail, fax or e-mail within 14 (fourteen) days, and the product must not be used within the framework of the provisions of ‘Products For Which The Right Of Withdrawal Can Not Be Exercised’ set forth in this contract.

USE OF RIGHT OF WITHDRAWAL:

16.   The invoice of the product delivered to the 3rd party or the BUYER (If the invoice of the product to be returned is corporate, it must be sent with the return invoice issued by the institution when returning it. Order returns whose invoices are issued on behalf of the institutions will not be completed unless the RETURN INVOICE is issued.)

17.   The return form, must be delivered with the products to be returned, complete and undamaged, including box, packaging, standard accessories, if any.

RETURN CONDITIONS:

18.   The SELLER is obliged to return, the total price and the documents that put the BUYER under debt within 10 days starting from the receipt of the withdrawal notification, to the BUYER and to receive the goods from the BUYER within 20 days.

19.   If there is a decrease in the value of the goods due to a reason caused by the BUYER 's fault or if the refund becomes impossible, the BUYER is obliged to compensate the damages of the SELLER at the rate of the fault. However, the BUYER is not responsible for the changes and deteriorations that occur due to the proper use of the product or product within the right of withdrawal period.

20.   Due to the use of Right of Withdrawal If the cost of the product goes below the campaign limit amount is set by the SELLER, then the discount amount used within the scope of the campaign is canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CAN NOT BE EXERCISED:

21.   Underwear, underwear, swimwear and bikini bottoms, make-up items, disposable products, goods which are prepared in accordance with the BUYER's request or clearly personal needs and which are not suitable to be returned back, goods that are in danger of rapid deterioration or the possibility of passing expiration date are delivered to the BUYER. products that are unsuitable in terms of health and hygiene to be returned if the package is opened by the BUYER after being delivered, products which are mixed with other products after delivery and which are not possible to be separated by their nature, Goods related to periodical publications such as newspapers and magazines, services or intangible goods delivered to the BUYER, as well as audio or video recordings, books, digital content, software programs, data storage and storage devices, computer consumables, packaging. If it is opened by the BUYER, it is not possible to return it as per the Regulation. Furthermore, before the expiration of the right of withdrawal, it is not possible to use the right of withdrawal for the services started with the approval of the consumer.

22.   Cosmetics and personal care products, underwear products, swimwear, bikinis, books, reproducable software and programs, DVD, VCD, CD and cassettes and stationery consumables (toner, cartridge, ribbon, etc.) can be returned unpacked, untested, unspoiled and they must be intact and unused.

DEFAULT AND LEGAL RESULTS

23.   If the BUYER defaults in the case of payment by credit card, the BUYER accepts, declares and undertakes that he/she will pay interest under the credit card agreement with the cardholder bank and be liable to the bank. In this case, the relevant bank may apply for legal remedies; and the BUYER agrees that the BUYER will pay the loss and loss incurred due to the delayed performance of the debt to the SELLER.
